Q: Does the school district qualify
as a 501(c)(3)?
A: Elk Grove Unified School District is
a tax-exempt organization; though, it is not tax
exempt under section 501(c)(3) of the IRS tax
code. As a public school district, EGUSD legally
is a political subdivision of the State of California,
organized under the state's Education Code. The
district is a government agency. Government agencies
are tax free and not required to have a tax exempt
status under section 501(c)(3).
If the funding agency says that they contribute
to 501(c)(3) organizations and does not specifically
mention schools or school districts in their criteria,
you should contact the funding agency to confirm
your site's eligibility to apply for funding.
